On July 24, 2006 Mr. Kenneth B. Jones Esquire, PHP Counsel sent a letter to Dr. Berwick's husband/Business Manager, Robert P. Hussey concerning some of the content contained in materials being distributed to medical doctors in the Pittsburgh area and posted on themedigatecase.com web site. A copy of this letter can be viewed by clicking the link below. Additionally, Mr. Hussey responded to this letter on August 2, 2006 and his response can also be viewed by clicking the appropriate link below. We have implemented some changes to the web site as requested by Mr. Jones: [1] The site identified the PHP as a state agency. This was in error, the PHP is a private peer assistance program supported by the Pennsylvania Medical Society; [2] We made the claim that the PHP sent letters to institutions notifying them that Dr. Berwick was in their program - Mr. Jones claims this is false, that they never sent letters to institutions where Dr. Berwick practiced. We have removed all references to State agency and since to date a copy of the notification letters has not been obtained we have removed this allegation at this time.
